**WASHINGTON** — The cryptocurrency industry moved significantly closer to regulatory clarity this week after the SEC proposed new rules, Congress continued debating separate legislation, the White House advanced its own priorities, and multiple federal agencies remained involved in determining which parts of crypto each of them regulates.

Officials described the framework as refreshingly straightforward.

Under the emerging system, a digital asset may be regulated by the SEC unless it falls under the CFTC, except where banking regulators have jurisdiction, Treasury has concerns, Congress eventually passes something different, or the White House directs agencies to interpret everything another way.

“This is the clearest the rules have ever been,” said one Washington official. “We now know exactly which seven institutions we need to ask before finding out nobody agrees.”

The proposed CLARITY Act is intended to establish clearer boundaries between regulators and provide market participants with greater certainty.

To ensure that certainty is comprehensive, it must first pass the House, survive the Senate, reconcile competing versions, receive presidential approval, interact correctly with SEC rulemaking, coexist with CFTC authority, accommodate banking law, and withstand several years of litigation.

Industry lawyers welcomed the progress.

“For the first time, companies can confidently plan around a regulatory framework,” said one attorney, “provided they know what Congress, the SEC, CFTC, Treasury, banking regulators, federal courts, and the next administration are going to do.”

Washington emphasized that this is what clarity looks like.
